A California couple is now facing lengthy prison sentences after a 1-year-old boy died from severe burns he suffered while left unattended in extremely hot bathwater, according to the San Bernardino County District Attorney’s Office.
Sergio Mena, 34, pleaded guilty to second-degree murder and child abuse resulting in great bodily injury. Samantha Garver, 36, the boy’s mother, was convicted of manslaughter and child abuse causing great bodily injury. Mena received a sentence of 21 years to life, while Garver was sentenced to 14 years.
The incident took place in September 2023 at a home in the Sugarloaf area, where Mena was watching the child, Henry, while Garver was away. Authorities say Mena placed the boy in scalding water and stepped away from the home briefly. When he returned, the child was found severely burned and in distress.
Rather than seeking emergency medical treatment, prosecutors say the couple attempted to treat the child’s injuries at home using an over-the-counter ointment. It wasn’t until the following day that emergency services were contacted, after the boy reportedly began struggling to breathe. When paramedics arrived, the child had no pulse and showed signs of prolonged dehydration and cold body temperature.
A subsequent investigation revealed the boy had suffered second- and third-degree burns, along with multiple healing fractures and bruising, suggesting a pattern of abuse that had gone on for some time. Officials say the child’s death was ultimately attributed to abuse and neglect.
In a statement, the San Bernardino County District Attorney’s Office said the sentencing “delivers justice” for the child, adding that the office remains committed to protecting vulnerable children in the community.
Authorities have not indicated whether any additional charges are being considered related to the broader abuse allegations uncovered during the investigation.
